Recommendation:  That the Council consider Ordinance No. 2386 amending section 17.0315 of the municipal code regarding drive-in and drive-through facilities  in the B-4, Highway Business zoning district.

Background:  Staff is requesting an amendment to Section 17.0315 of the City of Oak Creek Zoning Ordinance regarding drive-in and drive-through facilities in the B-4, Highway Business District.  Currently drive-in and drive-through facilities are a permitted use in the B-4 district.  Staff is concerned about the lack of control the City has over these facilities and is therefore recommending making any drive-through and drive-in facilities a conditional use in the B-4 zoning district. Currently any B-4 property, regardless of conditions that would make a drive-through problematic, are allowed a drive-through as a permitted use.  Making them a conditional use would allow the City to place additional restrictions when site conditions such as proximity to residential districts and traffic or access problems exist.

The Plan Commission has reviewed this proposed amendment, and has recommended that it be approved.

Fiscal Impact:  There is no direct fiscal impact associated with this change.
