AN ORDINANCE TO REPEAL AND RECREATE

SECTION 10.65(b)(1), SECTION 10.65(c)(1) AND

SECTION 10.65(e) OF THE MUNICIPAL CODE

REGARDING JUNKED MOTOR VEHICLES.

 

 

The Common Council of the City of Oak Creek does hereby ordain as follows:

 

SECTION 1:    Section 10.65(b)(1) of the Municipal Code is hereby repealed and recreated to read as follows:

 

SECTION 10.65, JUNKED MOTOR VEHICLES.

 

(b)        Definitions.  The following definitions shall be applicable in this section:

1.         Junked Motor Vehicle.  A motor vehicle which is:

a.         Not in good and safe operating condition, as provided in Chapter 347 Wis. Stats., or

b.         Missing parts including, but not limited to windows, lights, frames, bumpers or engine parts, all as required by Chapter 347 Wis. Stats., or

c.         Unregistered pursuant to Chapter 341 Wis. Stats.

 

Section 2:    Section 10.65(c)(1) of the Municipal Code is hereby repealed and recreated to read as follows:

 

SECTION 10.65, JUNKED MOTOR VEHICLES.

 

(c)        Violations.

(1)        No junked motor vehicle or junked motor vehicle parts shall be stored or allowed to remain on private property within the City, unless it is in connection with an authorized and lawful sales or repair business or towing business, or unless it is stored in a building or is stored behind a fence so that the junked motor vehicle or junked motor vehicle parts are shielded from public view and from the view of neighboring properties.

 

SECTION 3:    Section 10.65(e) of the Municipal Code is hereby repealed and recreated to read as follows: 

 

 

 

 

SECTION 10.65, JUNKED MOTOR VEHICLES.

 

(e)        Penalty.  In addition to other remedies provided by law, any party violating this Section shall be subject to the penalty provisions of Section 1.07 of this Code of Ordinances.  Each and every day during which a junked motor vehicle remains on public or private property more than fifteen (15) days after service of the notice provided in Subsection (d)(1) shall be deemed a separate offense.

 

Section 4:    All ordinances and parts of ordinances in contravention to this ordinance are hereby repealed.

 

SECTION 5:  This ordinance shall take effect and be in force from and after its passage and publication.
