Recommendation:  That the Council consider Ordinance No. 2375 amending sections 17.0305, 17.0306, 17.0307, 17.0308, and 17.0310 of the municipal code regarding the side yard setbacks for residential buildings with side entry garages.

 

Background:  City staff is requesting a zoning text amendment that will change the way the City measures side yard setbacks for side entry garages.  Currently the measurement is taken from a line that is perpendicular to the lot line.  The new ordinance would measure this setback from a line perpendicular to the garage door opening that is closest to the side lot line. The new ordinance text would impact all single family and duplex residential zoning districts and reads as follows:

 

“For structures with a side-entry garage, the setback shall be not less than twenty-seven (27) feet in width as measured along a line perpendicular from and starting at the closest point on a garage door opening to the side lot line.”

 

This item is being brought back to the Common Council because the Municipal Code Chapter reference numbers were incorrectly published when this was before the Council on August 16, 2005.

 

The Plan Commission has reviewed this proposed amendment, and has recommended that it be approved.

 

Fiscal Impact:  There is no fiscal impact associated with this change.
