Recommendation:  That the Council adopt Ordinance No. 2337, which would amend the official map for the Southeast ¼ of Section 28.

Background:  Micjensar Development is requesting to amend the official map for the Southeast ¼ of Section 28.  This official map amendment is being requested as the first step in the development of the Shepard’s Orchard Subdivision development. 

This request has been the subject of numerous neighborhood meetings as well as much debate at the January 27, 2004 Plan Commission, where the item was held.  Transcripts of these meetings are available upon request from the Planning Department or on the City of Oak Creek website at http://www.oakcreekwi.org/Calendar/2004/01_2004.htm .

The major issue in this proposal was the extension of E. Oak Lane.  The property owners at 1125 E. Oak Lane, Timothy and Jill Stout, had rescinded a road reservation that was previously recorded as part of a Certified Survey Map.  The applicant then requested a revision to the Official Map that eliminated the extension of E. Oak Lane, but the item was held because the City did not want to see the E. Oak Lane extension eliminated.

The applicant, Micjensar Development, has reached an agreement with the Stout’s (the owners of 1125 E. Oak Lane) which will provide them with the right of way that is required to extend E. Oak Lane. 

The Plan Commission has reviewed this request and has recommended that the official map be amended as requested.

Fiscal Impact:  The realignment of this street pattern on the official map does not have any direct fiscal impact on the City.
