Recommendation:  That the Common Council adopt Ordinance No. 2323, an ordinance to repeal Section 13.01 through 13.11 relating to ground cover, to repeal Section 13.80 through 13.87 and to recreate it as Section 13.01 through Section 13.11 relating to the control of construction site erosion resulting from land disturbing construction activities, and to create Section 13.12 through 13.14 relating to the control of construction site erosion resulting from land disturbing construction activities.

Background:  The proposed construction site erosion control ordinance was developed to comply with Chapters NR 151 and NR 216 of the Wisconsin Administrative Code.  A draft copy of the ordinance was contained in the 2003 NR 216 Annual Report.  The DNR reviewed and approved the draft ordinance for compliance with NR 151 and NR 216.  This ordinance will replace the existing ground cover and erosion control ordinances.

Fiscal Impact:  None.
