Recommendation: That the Common Council adopts Resolution No. 10398-090704, accepting water main easements in the Creek Side Manor Subdivision. (2nd Aldermanic District).
Background: The easements are necessary to replace a temporary easement used prior to the Glen Crossing Subdivision. When the Creek Side Manor subdivision was constructed it included a cul-de-sac with no access. The solution approved was to install a temporary road until the land to the south developed. The Glen Crossing subdivision has now developed providing permanent access to Park View Ct. There is an existing water main under the temporary access road. With the removal of the temporary access road and associated easement, the easement restriction on the property can be reduced by 10 feet. The existing easement is 20 feet and the water main easement will be 10’.

WHEREAS, the City of Oak Creek desires to maintain a water main in easements from Park View Ct. to Wilding Drive; and
WHEREAS, an existing temporary road is to be removed along the south side of the Creekside Manor 1st Addition under which is a water main.
WHEREAS, the existing temporary easement is no longer needed and should be replaced with a permanent water main easement
WHEREAS, the water main easements have been prepared affecting the following property owner, to wit:
Ronald and Vivian Krause
8283 and 8283 R S Park View Ct.
Tax Key Nos. 812-0209 and 812-0210
and said easements are attached hereto.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Common Council of the City of Oak Creek that the attached water main easements are hereby approved and accepted.
BE IT FURTHER RESOLVED, that the Mayor and City Clerk are hereby authorized and directed to execute the attached easements on behalf of the Common Council of the City of Oak Creek and upon said execution, the City Attorney is hereby authorized and directed to record the easement documents in the Office of the Register of Deeds in and for Milwaukee County, Wisconsin.
