Recommendation: That the Council adopt Resolution No. 10394-080204, which would approve the development agreement for the Willow Creek Estates Subdivision at 1701 and 1929 E. Oakwood Road.
Background: TES Properties, LLC is requesting approval of a development agreement for the subdivision known as Willow Creek Estates, at 1701 and 1929 E. Oakwood Road. The subdivision would create 36 lots in the Rs-2, Single Family Residential zoning district. Lots within this zoning district must have a minimum area of 17,000 square feet with a minimum lot width of 100 feet. Each of the lots within this subdivision meets or exceeds those minimum criteria.
The proposed subdivision layout substantially conforms to the official map that was adopted for this neighborhood.
The Plan Commission reviewed and approved the preliminary plat for this subdivision at their meeting of May 28, 2004.
Fiscal Impact: In general, these lots and the homes built upon them, will likely have a positive impact on the City’s tax base, and will provide at least $82,332 in bikeway and impact fees.

RESOLUTION APPROVING THE
DEVELOPMENT AGREEMENT
FOR WILLOW CREEK ESTATES
(5th Aldermanic District)
WHEREAS on May 28, 2004 the Oak Creek Plan Commission conditionally approved the preliminary plat for the subdivision to be known as Willow Creek Estates; at 1701 and 1929 E. Oakwood Road, and,
WHEREAS one of the conditions of that approval was that a development agreement is entered into between the owner(s) and the City to address the installation of public improvements; and,
WHEREAS Chapter 14 of the Municipal Code also requires that a development agreement be entered into prior to the required public improvements being installed; and,
WHEREAS upon completion of the required improvements and the issuance of a certification to that effect by the City Engineer, a subsequent resolution will be presented for final plat approval.
THEREFORE, BE IT RESOLVED that the Development Agreement attached hereto and incorporated herein by reference, by TES PROPERTIES, LLC as party of the first part, and the CITY OF OAK CREEK as party of the second part, be and the same is hereby approved.
