Recommendation: That the Council adopt Resolution No. 10385-080204, which would approve the development agreement for the Pioneer Estates Addition No. 4 Subdivision at 601 E. Drexel Avenue and 620 and 630 E. Lakeview Drive.
Background: Brian Schoenleber is requesting approval of a development agreement for the subdivision known as Pioneer Estates Addition No. 4, at 601 E. Drexel Avenue and 620 and 630 E. Lakeview Drive. The subdivision would create 10 lots in the Rs-3, Single Family Residential zoning district. Lots within this zoning district must have a minimum area of 12,000 square feet, with a minimum lot width of 80 feet. Each of the lots within this subdivision meets or exceeds those minimum criteria. In fact, the average lot size within this subdivision is 14,380 square feet (.33 acre), or a gross density of 1.55 dwelling units per acre.
The developer of this phase of the subdivision would be responsible for completing the improvements (sidewalk, street lights, second lift of asphalt) for the third phase of the subdivision, which was also developed by the same ownership.
The Plan Commission reviewed and approved the preliminary plat for this subdivision at their meeting of May 25, 2004.
Fiscal Impact: This subdivision will generate approximately $16,840 in imipact and development fees as permits are issued for homes to be built on these lots.
Recent data has suggested that homes constructed on the newly created parcels would have to have an assessed value in excess of $249,577 in order to generate revenues equal to costs.

RESOLUTION APPROVING THE
FOR PIONEER ESTATES ADDITION NO. 4
(3rd ALDERMANIC DISTRICT)
WHEREAS on May 25, 2004 the Oak Creek Plan Commission conditionally approved the preliminary plat for a subdivision development known as Pioneer Estates Addition No. 4, at 601 E. Drexel Avenue and 620, 630 E. Lakeview Drive; and,
WHEREAS one of the conditions of that approval was that a development agreement is entered into between the owner(s) and the City to address the installation of public improvements; and,
WHEREAS Chapter 14 of the Municipal Code also requires that a development agreement be entered into prior to the required public improvements being installed; and,
WHEREAS upon completion of the required improvements and the issuance of a certification to that effect by the City Engineer, a subsequent resolution will be presented for final plat approval.
THEREFORE, BE IT RESOLVED that the Development Agreement attached hereto and incorporated herein by reference, by BRIAN SCHOENLEBER as party of the first part, and the CITY OF OAK CREEK as party of the second part, be and the same is hereby approved.
