Recommendation:  That the Common Council adopt Ordinance No. 2312 to repeal and recreate Sections15.201(a) (b), 15.202 (a)(m)-(n)-(o)-(p)-(q)-(r), 15.203, 15.204(a)-(b),15.206(b) (3), 15.207(a), 15.215(b),15.217(a)(8)-(10) –(b)(1)(c)(2)-(d)-(f), 15.218(a)(4)(7)-(c), 15.220 (t), and 15.223 of the Fire Prevention Code. 

 

Background:  The changes in the Fire Prevention Code reflect:  the new state building and fire prevention codes, unbiased gender designation, and the deletion of replaced or no longer current codes or regulations.

·         The present Fire Code does not specifically address the change in the State Building and Fire Code changes that are in effect as of July 1, 2002.  The Department of Commerce adopted the Wisconsin Enrolled Commercial Building Code (International Building Code) and Comm 14.02 (National Fire Protection Association Code #1).  The changes in the Fire Prevention Code reflect this change.

·         The present code reflects male only gender designation and the changes reflect unbiased gender designation.

·         The present code reflects Comm and ILHR codes that are no longer current state codes or regulations.  This change removes these sections.

·         SEC.201 (a) (The most current available printed version of NFPA 13, 13R, and 13D Automatic Sprinkler Systems will be enforced)  is added to the present code to allow builders and developers to take advantage of the recent developments and alternatives in complying with the minimum requirements of automatic fire sprinkler systems.  

 

Fiscal Impact:  No significant change:  The revised state code is enforceable only through the state.  Citations issued on state code violations specify the proceeds or fines go to the state.  If the City of Oak Creek adopts the same codes the proceeds from code enforcement by the City would go to the City.  Fines for violations of the code requirements are the Fire Department’s last recourse.  Compliance is our main objective through education and training.
