Recommendation: That the Common Council adopts Ordinance No. 2311; an ordinance to repeal and recreate Section 3.40(c) (33) and (34) relating to fees, permits and charges.
Background: In working with the City Attorney, Section 3.40 (33) was recreated to have the Street Department fees put into one section of the Municipal code.
For the last several years, the State of Wisconsin mandates that freon appliances must be taken to an approved site in order to have the freon removed. The Street Department hauls these appliances to the freon removal drop-off site in Milwaukee at a cost of $9.00 per appliance which includes refrigerators, freezers, dehumidifiers and air conditioners.
The table below shows the costs incurred by the City of Oak Creek since 1997 for the disposal of freon appliances:

In charging a $15.00 fee, the City will be able to recover the costs of recycling freon appliances. The $15.00 fee would cover all appliances brought to the drop off site as well as appliances picked up as part of a special pick up (curbside).
Fiscal Impact: We will recover approximately $4,000.00 of our costs for the last six (6) months of 2004 and approximately $6,000 to $8,000.00 in future years.
