Recommendation:  That the Council adopt Ordinance No. 2308 amending Section 17.0904 of the Municipal Code regarding existing non conforming lots.

Background:  Section 17.0904 of the Municipal Code regulates how, and under what circumstances, one may develop an existing lot of record that does not meet the dimensional requirements of the Zoning Code.

The City Attorney has been reviewing this section, and feels that the current language is not appropriate.  The revised text provides a legally defensible means of regulating any development activity on these lots.  This primarily affects those lots, many of which are as narrow as 40 feet that were recorded prior to the effective date of the zoning ordinance.  This language requires that, where possible, these lots be combined to increase their width in order to get a building permit.

The Plan Commission has reviewed this request and has recommended its approval.
