Recommendation:  That the Common Council adopt Ordinance No. 2295 to repeal and adopt Table 14.103 located in Section 14.103 of the Municipal Code.

 

Background:  At the December 2, 2003 Common Council meeting, the Council adopted changes regarding streetlights and storm sewer systems as recommended in Ordinance No. 2283 relating to street grading.  The proposed street tree requirement recommendation for zoning district RS-1 and RS-2 was referred back to the CIP Committee.

 

This issue was discussed with staff at the January 9 and January 18, 2004 CIP Committee meetings.  Discussion focused on 1) The benefits of trees and public street trees (economic, environmental, and social/psychological).  2) The loss of the benefits of public street trees by having only private property residential tree planting.  3) The difficulty of developing and enforcing an ordinance requiring private property residential tree planting that would replace public street tree planting.

 

On a 2 to 1 vote, the CIP Committee is forwarding the recommendation to Council to require street trees in zoning districts RS-1 and RS-2.

 

Fiscal Impact:  None at this time.  The developer will pay the initial capital costs.  The City will be responsible for maintenance and long term replacement.

The City of Oak Creek Common Council does hereby ordain as follows:

 

Section 1:         Table 14.103 contained within Section 14.103(c) is hereby repealed and recreated to read as follows:
