Recommendation:  That the Council adopt Resolution No. 10342-030204, approving a certified survey map for the property at 7841 S. Howell Avenue subject to technical corrections and a signed agreement with the Water and Sewer Utility concerning shared access to Drexel Avenue.

 

Background:  Rodney Dent is requesting approval of a certified survey map that will redivide the property at 7841 S. Howell Avenue into parcels of 2.3, 1.9 and 1.4 acres as well an outlot for storm detention.  The existing Culver’s restaurant is on Lot 3.  Lots 1 and 2 would be available for future development.

 

This property is zoned B-2, Community Business, with a conditional use permit for a restaurant drive through.  Lots in the B-2 district must provide sufficient area and width for the principal structure(s) and its accessory structures, off-street parking and loading areas, and required setbacks.   There is no required minimum area or width.

 

In any case, each of these parcels would allow for development in accordance with the City’s ordinances, and should be approved.  The only conditions that staff would like to see are the allowance for a shared driveway to Drexel Avenue with the Water and Sewer Utility.  As proposed, Lot 1 would have 55 feet of width along Drexel Avenue.  Unfortunately, this frontage does not line up with the median opening in that location.  It would make more sense to reach an agreement on the shared use of the existing driveway rather than having a new drive that does not align with the median. 

 

The Wisconsin Department of Transportation is requiring modifications to the existing median and turn lanes on Howell Avenue as a condition of their approval of the CSM.  This will involve closure of the existing median opening at the north end of the left turn lane.  This median opening will be relocated to the north to allow for a safer intersection.

 

The applicants have been working with the Water and Sewer Utility and have come to a consensus on the design of shared driveway facilities.  This arrangement should be solidified prior to recording of the CSM.  The Plan Commission also required that an additional 20 feet be added to Outlot 1

 

The Plan Commission has reviewed this request and has recommended its approval.

 

Fiscal Impact:  The subdivision of this property is one step in the commercial development of these lots, which will have a positive fiscal impact.
