Recommendation: That the Common Council adopts Resolution No. 10341-030204, accepting permanent water main easements for Project No. 01103, the east-west transmission water main project planned for 2005 (3rd and 4th Aldermanic Districts).
Background: The easements are necessary for the installation of transmission water main outside of the existing street right-of-way. The alignment chosen minimizes the street excavation and associated disruptions and pavement patches. This also reduces the overall construction costs. This water main is part of stage 1 of the Utility’s master plan and is needed to reinforce the existing water main network, improve reliability, and reduce increasing pumping costs by providing a lower resistance path within the network.
The Oak Creek Water & Sewer Utility, for the last 2 years, has been conducting preliminary design of a 36” transmission water main to connect a transmission main in Chicago Road to transmission main recently installed in Nicholson Road. Along with preliminary engineering this phase has included alignment evaluation and easement acquisition. Nearly all of the easements have been acquired to date and the Common Council is being asked to accept them at this time.
There are no special assessments for this project because it is strictly a transmission main project and no benefit will be received by abutting property owners. The Water and Sewer Utility will fund the project. The proposed water main route is depicted on the attached map.
Fiscal Impact: The total cost of acquiring these easements is $9,500.00 and will be funded by the Water and Sewer Utility.

WHEREAS, the City of Oak Creek desires to install a transmission water main in easements from Chicago Road to Nicholson Road; and
WHEREAS, to enable the City to construct and maintain said water main, it will be necessary that permanent water main easements be obtained from the affected property owners; and
WHEREAS, the permanent water main easements have been prepared affecting the following property owners, to wit:

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Common Council of the City of Oak Creek that the attached permanent water main easements are hereby approved and accepted.
BE IT FURTHER RESOLVED, that the Mayor and City Clerk are hereby authorized and directed to execute the attached easements on behalf of the Common Council of the City of Oak Creek and upon said execution, the City Attorney is hereby authorized and directed to record the easement documents in the Office of the Register of Deeds in and for Milwaukee County, Wisconsin.
