Recommendation:  That the Common Council adopt Resolution No. 10349-031604, a resolution releasing the Developer, Premier Development, from the terms and conditions of their Northbrook Subdivision development agreement, City Project No. 94010 (Tax Key Nos. 869-0176, 0177,0182-0188, 0194-0207), (4th Aldermanic District).

 

BACKGROUND:  The Developer has completed, to the satisfaction of the Engineering Department, all required street improvements for Northbrook Subdivision.  There are no current outstanding assessments against the properties and the Developer has paid all required City fees and costs.  Therefore, the City should release the Developer from the terms and conditions of the development agreement.

 

FISCAL IMPACT: None.

RESOLUTION RELEASING DEVELOPER FROM AGREEMENT

 

NORTHBROOK SUBDIVISION

 

(PROJECT NO. 94010)

 

(4TH ALDERMANIC DISTRICT)

 

            WHEREAS, Premier Development, hereinafter referred to as the “Developer”, has constructed the improvements required by the Addition No. 4 Subdivision, and

 

            WHEREAS, the development agreement provided that the Developer shall comply with all conditions of the approved public improvement plans, and

 

            WHEREAS, the Developer has met all the conditions of the approved grading, sanitary sewer, water main, storm sewer and street plans for Northbrook Subdivision, and

 

            NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oak Creek, that the Developer is hereby released from all terms and conditions of the Northbrook Subdivision development agreement.

 

            Introduced at a regular meeting of the Common Council of the City of Oak Creek held this 16th day of March, 2004.

 

            Passed and adopted this 16th day of March, 2004.
