Recommendation:  That the Common Council adopt Resolution No. 10436-120704, a resolution releasing the Developer, Midwest Homes of Wisconsin, Inc., from the terms and conditions of their Barton Oaks and Barton Oaks Addition No. 1 Subdivisions development agreements, City Project Nos. 91081, 91082, 96060, 96061 (Tax Key Nos. 962-0091 to 0118 and 962-0122 to 0155), (4^th Aldermanic District).

BACKGROUND:  The Developer has completed, to the satisfaction of the Engineering Department, all required public improvements for Barton Oaks and Barton Oaks Addition No. 1 Subdivisions.  There are no current outstanding assessments against the properties and the Developer has paid all required City fees and costs.  Therefore, the City should release the Developer from the terms and conditions of the development agreement.

FISCAL IMPACT: None.
