Recommendation:  That the Common Council adopt Resolution No. 10441-122104, a resolution releasing the Developer, Midwest Homes of Wisconsin, Inc., from the terms and conditions of their Northbrook Addition No. 1 subdivision development agreement, City Project Nos. 97063, 97064 (Tax Key Nos. 870-0093 to 0119) (4th Aldermanic District).

 

BACKGROUND:  The Developer has completed, to the satisfaction of the Engineering Department, all required public improvements for Northbrook Addition No. 1 Subdivision.  There are no current outstanding assessments against the properties and the Developer has paid all required City fees and costs.  Therefore, the City should release the Developer from the terms and conditions of the development agreement.

 

FISCAL IMPACT: None.

RESOLUTION RELEASING DEVELOPER FROM AGREEMENT

 

NORTHBROOK ADDITION NO. 1 SUBDIVISION

 

(PROJECT NOS. 97063, 97064)

 

(4TH ALDERMANIC DISTRICT)

 

            WHEREAS, Midwest Homes of Wisconsin, Inc., hereinafter referred to as the “Developer”, has constructed the public improvements required by the Northbrook Addition No. 1 Subdivision, and

 

            WHEREAS, the development agreement provided that the Developer shall comply with all conditions of the approved public improvement plans, and

 

            WHEREAS, the Developer has met all the conditions of the approved grading, sanitary sewer, water main, storm sewer, sidewalks, and street plans for Northbrook Addition No. 1 Subdivision, and

 

            NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oak Creek, that the Developer is hereby released from all terms and conditions of the Northbrook Addition No. 1 Subdivision development agreement.

 

            Introduced at a regular meeting of the Common Council of the City of Oak Creek held this 21st day of December, 2004.

 

            Passed and adopted this 21st day of December, 2004.
