Recommendation: That the Common Council approve Resolution No. 10439-122104, a resolution approving the vacation of an existing 20’ wide temporary road easement as shown on Outlots 1 and 2 of the Creekside Manor Addition No. 1 Subdivision plat and on Lot 23, of the Creekside Manor Subdivision plat (Tax Key Nos. 812-0192, 0209, 0210) (Project No. 93052) (2nd Aldermanic District).
Background: Construction of the Creekside Manor Addition No. 1 subdivision necessitated the construction of a temporary road between S. Wilding Drive and S. Park View Court. This temporary road was constructed within a twenty foot wide temporary road easement. This situation existed for twelve years. In 2003, the construction of Glen Crossing Subdivision connected S. Wilding Drive and S. Park View Court into the new Glen Crossing subdivision, thus eliminating the necessity of the temporary road. The property owners involved also wish to have the temporary road easement removed.

LOT 23, CREEKSIDE MANOR SUBDIVISION PLAT AND OUTLOTS 1 AND 2, CREEKSIDE MANOR ADDITION NO. 1 SUBDIVISION PLAT.

WHEREAS, a 20’ wide temporary road easement exists on Lot 23, Creekside Manor Subdivision plat and on Outlots 1 and 2, Creekside Manor Addition No. 1 Subdivision plat for the purpose of allowing the construction of a temporary road access from S. Wilding Drive to S. Park View Court, and
WHEREAS, the extension of S. Wilding Drive and S. Park View Court into the newly constructed Glen Crossing Subdivision has eliminated the need for said temporary access road,
NOW, THEREFORE BE IT RESOLVED by the Mayor and the Common Council of the City of Oak Creek that the 20’ wide temporary road access easement as shown on Lot 23, Creekside Manor Subdivision plat and Outlots 1 and 2 of the Creekside Manor Addition No. 1 Subdivision plat shall be vacated, and
BE IT FURTHER RESOLVED, that the City Clerk is hereby authorized and directed to cause a certified copy of the resolution to be recorded in the office of the Register of Deeds in and for Milwaukee County, Wisconsin.
