Recommendation:  That the Council adopt Resolution No. 10336-012004, which would approve the development agreement for the first phase of Oakwood Crossings at 10101 S. Howell Avenue.

 

Background:  The Opus North Corporation is requesting Common Council approval of the development agreement for the first phase of the Oakwood Crossings Business Park at the northwest corner of Howell Avenue and Oakwood Road.

 

The first phase consists of 139,824 square foot building.  The site and building plans for this first phase were conditionally approved by the Plan Commission on February 25th of last year.  One of those conditions was that a development agreement be entered into between the City and the property owners to identify the required public facility improvements, including public water and roadway, prior to the issuance of building permits for the first phase.

 

This development agreement includes language addressing the timing and responsibility for public improvements such as the public interior site access road, public watermain within that access road and public road improvements to the intersection of S. Howell Avenue and W. Oakwood Road, including the installation of traffic control signals.

 

This development agreement requires that those public improvements be completed prior to the issuance of occupancy permits.  However, the City realizes that work within the right of way for  Howell Avenue (STH 38) requires a level of involvement from the Wisconsin Department of Transportation that is not under the control of the developer or City.  As such, a provision in the development agreement would give the City the discretion to limit occupancy of any portions of the first phase to uses (as determined by the Police Chief, Fire Chief and City Engineer) that would not have an adverse impact on the safety of the Howell/Oakwood intersection.

 

Fiscal Impact:  Outstanding assessments of $45,056.36 would be paid to the City as part of this development agreement.  The development of this, and future phases of the Oakwood Crossings Business Park will provide opportunities for expansion of the nonresidential tax base.
