Recommendation:  That the Council adopt Resolution No. 10277-090203, which would approve the development agreement for the Patriot Arms subdivision at 1101R E. Forest Hill Avenue.

 

Background:  Michael Wood is requesting Common Council approval of the development agreement for the Patriot Arms subdivision at 1101R E. Forest Hill Avenue.  This subdivision, formerly known as Nature Haven consists of 8 lots in the Rs-3, Single Family Residential zoning district.  The lots have been increased in size to meet the new width and area requirements.

 

The Plan Commission originally approved the preliminary plat for this subdivision in July of 1999.  State statutes state that if the final plat is not submitted within 24 months after the last required approval of the preliminary plat, any approving authority may refuse to approve the final plat.   Since this plat was approved more than two years ago, the City would have had the ability to object to it.

 

The Plan Commission reviewed and approved the revised preliminary plat for this subdivision at their meeting of August 12, 2003

 

 

Fiscal Impact:  In general these lots will not provide a positive impact on the City’s tax base, but it will provide at least $13,072 in bikeway and impact fees.
