Recommendation: That the Council adopt Resolution No. 10274-090203, approving a certified survey map for the property at 1701 E. Oakwood Road.

Background: Scott Biller, on behalf of the James H. Biller Trust is requesting approval of a certified survey map that would subdivide the property at 1701 E. Oakwood Road into 3 parcels of roughly 1.5 acres and the remainder of the lands consisting of 5.49 acres.

Although the property in question has an Oakwood Road address, the newly created lots will actually be on S. Nicholson Road in an area bounded by the confluence of the Crayfish Creek. Each of the newly created lots exceeds the minimum requirements for the Rs-2 zoning district. There are significant areas designated as wetlands on the property. A grading plan has been prepared illustrating appropriate building locations outside of those wetland areas.

The adopted official map illustrates a short cul de sac providing access to the interior of this property. Given the presence of wetlands as earlier described, it is unlikely that a new public street would be a cost effective means of providing access to the property’s interior. Because the removal of this officially mapped street would not impact anyone other than the owner of this property, he is not required to go through the process of amending the official map. This will be accomplished as part of the land division process.

The Plan Commission has reviewed this certified survey map and has recommended its approval.

Fiscal Impact: There are outstanding assessments of $18,565.87 on this property. Recent data has suggested that any homes constructed on the newly created parcels would need to have an assessed value in excess of $249,577 in order to generate revenues equal to costs.
