Recommendation:  That the Council adopt Resolution No. 10279-090203, which would approve conditions and restrictions for a day care center with an outdoor activity area for the property at 7420 S. 1st Street.

Background:  At their meeting of August 4, 2003 the Common Council approved a conditional use permit for group day care with an outdoor activity area for the property at 7420 S. 1st Street (the new address is 100 W. Marquette Avenue).  At the time, a question was posed by the Council whether conditions and restrictions had been prepared for this conditional use.  Unfortunately I incorrectly stated that they had been prepared, when in reality the Plan Commission did not review them.

The attached conditions and restrictions were prepared to regulate this conditional use. They have been reviewed and recommended for approval by the Plan Commision.
