Recommendation:  That the Common Council adopt Ordinance No. 2268, to create Section 2.23(a)(4) of the Oak Creek Municipal Code relating to the Small Claims Committee.

Background:  The Small Claims Committee was established in 1998 to resolve claims under $500.00.  When the City became a member of Cities & Villages Mutual Insurance Company (CVMIC), the insurance carrier recommended that the Small Claims Committee be authorized to settle general non-injury claims up to $5,000.  The Common Council approved that authority in February, 2001.  On May 6, 2003 the Common Council adopted Resolution 10239-050603 which approved the authority and standard procedure of the committee. 

This ordinance will reflect the Small Claims Committee as a Standing Committee rather than an Ad Hoc Committee, which is appropriate since all voting members of the committee are elected officials.
