Recommendation:  That the Council adopt Resolution No. 10273-090203; which would approve the certified survey map for the property at 741 W. Ryan Road.

 

Background:  Charles Koehler is requesting approval of a certified survey map that would redivide the property at 741 W. Ryan Road into parcels of 6.9 and 33.2 acres.  The 6.9 acres north of the south branch of the Oak Creek contains the existing home and outbuildings on the property.  The remaining property lying south of the creek would remain under its agricultural use.

 

A 20-foot ingress and egress easement is being provided for the benefit of this southerly parcel.  Still, under the provisions of the Municipal Code, this parcel should be designated as an outlot since it does not have requisite public street frontage.  To remain buildable, this parcel would need to be approved as a variation under Section 14.180 of the Municipal Code. 

 

The Engineering Department has requested a dedication of the area adjacent to the south branch of the Oak Creek as illustrated on the official map for this property.  The owners have also requested a variation that would allow them to grant an easement along the north side of the watercourse in lieu of the required dedication.  The Water and Sewer Utility has also requested a 50’ x 50’ sanitary sewer easement.

 

The Plan Commission has reviewed this certified survey map, and has recommended its approval, including the requested variations, by the required 3/4 majority.

 

Fiscal Impact:  There is an existing home on Parcel 1.  The possibility exists for additional development on Parcel 2.  There are no outstanding assessments on this property.  By granting the requested variations, the City would be relinquishing its authority to acquire officially-mapped drainage ways through the land division process.  This drainage way, as well as the easements requested by the Water and Sewer Utility, may require funding if it is to be acquired in the future.
