RECOMMENDATION: That the Common Council adopt Resolution No. 10282-091603, a resolution approving a sanitary sewer connection agreement between Louie Rodriguez and Judith A. Strauss and the City of Oak Creek, approving a sanitary sewer connection agreement for 9772 S. Chicago Road, Tax Key No. 912-9931 (4th Aldermanic District).
BACKGROUND: Louie Rodriguez and Judith A. Strauss wish to connect an existing single family home at 9772 S. Chicago Road to existing public sanitary sewer to provide sanitary sewer service to this property. The Oak Creek Water and Sewer Utility has approved a sanitary sewer service lateral to connect to existing public sanitary sewer on the west side of S. Chicago Road. The agreement would allow the Louie Rodriguez and Judith A. Strauss property to connect to this sewer.
The connection agreement contains provisions for payment of a $4,000.00 connection fee. This fee would be applied to any future public sanitary sewer assessment fee. If the current connection fee is less than the future assessment, Rodriguez/Strauss is obligated to make up the difference. If the current connection fee is more than the future assessment fee, there is no refund forthcoming to Rodriguez/Strauss.
Further agreement provisions that Louie Rodriguez and Judith A Strauss have agreed to are: 1) to disconnect the sanitary sewer service lateral being installed under this agreement and reconnect to any future public sanitary sewer installed along the street frontage of 9772 S. Chicago Road 2) no objection to any future assessments for public sanitary sewer along the street frontage of 9772 S. Chicago Road.

BE IT RESOLVED that the sanitary sewer connection agreement attached hereto and incorporated herein by reference by and between Louie Rodriguez and Judith A. Strauss and the City of Oak Creek, providing for a sanitary sewer connection, be the same and is hereby approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk be and are hereby authorized and directed to execute said agreement for and on the behalf of the City.
