Recommendation: That the Common Council adopt Resolution No. 10258-070103, a resolution approving a storm water management practices maintenance agreement with S&L Holding, LLC for the Allied Domecq Trombo development at S. 20th Street and W. Ryan Road, Oak Creek, Tax Key No. 903-9996-004 (6th Aldermanic District).
Background: The proposed Allied Domecq Trombo development at S. 20th Street and W. Ryan Road requires onsite storm water management practices in accordance with Sections 13.100 through 13.114 of the Municipal Code. Section 13.109 of the Municipal Code requires a maintenance agreement between the City and the permittee for the future maintenance of the required storm water management practices. This development includes pervious pavement and a rain garden as part of a demonstration project sponsored by the MMSD. The maintenance agreement includes provisions requiring the owner to retrofit the site with a conventional detention basin if the pervious pavement and rain garden fail to function as designed to meet the requirements of the City’s storm water management ordinance.
Fiscal Impact: None. The owner is responsible for all costs per the Storm Water Management Practices Maintenance Agreement.
