Recommendation:  That the Council adopt Ordinance No. 2251, authorizing the issuance of a conditional use permit to the Wisconsin Energy Corporation for power generation, transmission and distribution for the properties in the M-1, Manufacturing zoning district at 4401, 4415, 4420, 4500, 4501, 4650, 4750, 4800 and 4801 E. Elm Road;             4285, 4299, 4431, 4451, 4503, 4513, 4541 and 4541R E. Oakwood Road; 10700, 10760, 10920, 11002, 11050 and 11050R S. Chicago Road.

Background:  We Energies is requesting a conditional use permit for power generation, transmission and distribution in support of their proposal to add generation capacity to the existing facility at 4801 E. Elm Road.  The memorandum included as part of the previous item provides additional documentation for this request.

The Plan Commission has reviewed the request for a conditional use permit, as well as the conditions and restrictions, and has recommended their approval.

Fiscal Impact:  The issuance of a conditional use permit for these parcels is one step in the process towards the construction of additional power generation, transmission and distribution facilities on the lands currently held by the Wisconsin Energy Corporation.  The City’s tentative agreement with We Energies would provide for community mitigation payments for the additional generator units as they come on line, as well as additional community investment over the next ten years.
