Recommendation:  That the Common Council adopt Resolution No. 10252-061703, a resolution approving a water lateral connection agreement with Ryan Road Storage at 840 W. Ryan Road, Oak Creek, Tax Key No. 876-9994 (6^th Aldermanic District).

Background:  The proposed new Ryan Road Storage development at 840 W. Ryan Road requires installation of a private water lateral connection.  The water lateral connection agreement will allow the installation to be performed under the direction and approval of the City.  The water lateral connection agreement has been approved by the Oak Creek Water and Sewer Utility. 

Fiscal Impact:  None. Per the water lateral agreement, the Developer is responsible for all costs.

RESOLUTION APPROVING A WATER LATERAL CONNECTUION AGREMENT

FOR RYAN ROAD STORAGE AT 840 W. RYAN ROAD

(TAX KEY NO. 876-9994)

(6^th ALDERMANIC DISTRICT)

                                                                                                            WHEREAS, Ryan Road Storage (Developer), requires private water lateral connection to service their proposed storage facility at 840 W. Ryan Road and,

                                                                                                            WHEREAS, the City requires that the Developer enter into a Water Lateral Connection Agreement, and,

                                                                                                            WHEREAS, the required water lateral agreement has been prepared and signed by the Developer,

                                                                                                            NOW, THEREFORE, BE IT RESOLVED by the Mayor and Common Council of the City of Oak Creek that the attached Water Lateral Connection Agreement, as signed by the Developer, is hereby approved by the City.

                                                                                                            BE IT FURTHER RESOLVED that the Mayor and the City Clerk are hereby authorized and directed to execute the attached agreement on behalf of the Common Council of the City of Oak Creek and upon execution by both the City of Oak Creek and the Developer, the City Attorney is hereby authorized and directed to record the same in the Office of the Register of Deeds in and for Milwaukee County, Wisconsin.
