RESOLUTION APPROVING THE

DEVELOPMENT AGREEMENT FOR

GLEN CROSSING

(2nd Aldermanic District)

WHEREAS on July 11, 2000 the Oak Creek Plan Commission conditionally approved the preliminary plat for the subdivision known as Glen Crossing; and,

WHEREAS Wisconsin Statutes 236.11(1)(b) reads that if the final plat is not submitted within 24 months after the last required approval of the preliminary plat, any approving authority may refuse to approve the final plat; and,

WHEREAS on June 10, 2003 the Oak Creek Plan Commission reaffirmed the approval of the preliminary plat for the subdivision; and,

 WHEREAS the subdivision is proposed to be developed in phases; and,

WHEREAS the preliminary plat for the first phase of the subdivision has been revised to meet the minimum lot and area requirements of the Rs-3 zoning district; and

WHEREAS Chapter 14 of the Municipal Code requires that a development agreement be entered into for each phase prior to the required public improvements being installed; and,

WHEREAS  upon completion of the required improvements and the issuance of a certification to that effect by the City Engineer, a subsequent resolution will be presented to approve the final plat for that phase of the subdivision.

THEREFORE, BE IT RESOLVED that the Development Agreement attached hereto and incorporated herein by reference, by the PILGRIM DEVELOPMENT GROUP, as party of the first part, and the CITY OF OAK CREEK as party of the second part, be and the same is hereby approved.
