Recommendation:  That the Council adopt Ordinance No. 2243, that would repeal and recreate Sections 17.0306(d)(1), 17.0307(d)(1) and 17.0308(d)(1) of the Municipal Code regarding minimum lot sizes and widths in residential zoning districts.

 

Background:  On February 4th of this year the Common Council accepted the recommendation of the Finance Committee and directed staff to prepare an ordinance increasing residential green space.  The proposed changes to minimum lot width and area are those that were proposed by the Finance Committee.  No changes are being proposed to the minimum home size.

 

As part of the adoption of this ordinance, Planning staff is proposing language to regulate the development of subdivision plats that are currently being processed, or have already received preliminary plat approval.  In these instances those subdivisions would be permitted to develop under the existing lot width and area standards, provided that the final plat is recorded within one year of the effective date of this ordinance.  This will allow them the opportunity to develop the subdivision based on the plans that have already prepared.  However it would give them a limited time period in which to record the plat or else they would be required to adhere to the new lot area and width requirements.

 

Fiscal Impact:  The adoption of this ordinance will increase the per lot infrastructure costs for subdividers of land within the City.  Since this cost will likely be passed on to purchasers, this should marginally increase the value of new lots in the City.
