Recommendation:  That the Council adopt Resolution No. 10223-031803; which would approve the certified survey map for the properties at 1900 W. Ryan Road and 9420 S. 20th Street.

Background:  Kenneth and Kari Krimpelbein and the Raymond Fischer Living Trust are requesting approval of a certified survey map that would redivide the two existing properties at 1900 W. Ryan Road and 9420 S. 20th Street.  As proposed an irregular 5,852 square foot portion of the property at 1900 W. Ryan Road would be transferred to the property at 9420 S. 20th Street (Value Inn).

Even under the proposed minor land division, both properties would meet the minimum requirements of the B-4, PUD zoning district.  Staff’s only concern was that of minimum green space.  Based on the approved site plans for Oak Creek Gym & Fitness/Krimpelbein Chiropractic, it appears that the site is very close to the minimum 30% open space required under the Municipal Code.  By transferring a portion of this property, the site would fall below this minimum.  The owner of the Value Inn has stated that he will retain this area as open space.  The Plan Commission would be in a position to enforce this through the approval of any revisions to their site plan.

Section 14.180 of the Municipal Code does allow for the Common Council, upon recommendation from the Plan Commission, to approve a variation or exception to this regulation. The Commission has recommended approval of this certified survey map by the required 3/4 majority.
