Recommendation:  That the Council adopt Resolution No. 10222-031803; which would approve the certified survey map for the properties at 7840 and 7860 S. Clement Avenue.

Background:  Barbara and Trevor Cox are requesting approval of a certified survey map that would redivide the two existing properties at 7860 S. Clement Avenue into parcels of 197,116 and 29,539 square feet.  Properties within the Rs-3 zoning district must have a minimum lot area of 10,000 square feet with a minimum lot width of 75 feet.  Properties within the A-1, Agricultural zoning district must be a minimum of five acres with a minimum lot width of 150 feet.  Corner lots are required to have an additional 10 feet in width.  Parcel 2 (Rs-3) meets this minimum criteria.  Parcel 1 (A-1) does not.  However, Parcel 1 as it exists today is only 197,142 square feet (4.52 acres).  In essence, this redivision of these properties would be reducing Parcel 1 by only 26 square feet.  This redivision is primarily for the purposes of providing a more rational property line boundary.  The existing property configuration was recorded as a result of the presence of officially-mapped streets on the two properties.  This accounts for the peculiar shape of Parcel 2.  This minor land division would “square off” the two properties.

Section 14.180 of the Municipal Code does allow for the Common Council, upon recommendation from the Plan Commission, to approve a variation or exception to this regulation.

Because Parcel 1 is zoned A-1 and Parcel 2 is zoned Rs-3, any change in the boundary lines for these two properties should be accompanied by a corresponding change to the zoning map.

Fiscal Impact:  No new lots are being created.  Any home built on Parcel 1 would be responsible for the payment of impact fees.
