Recommendation:

That the Common Council deny the request of Mr. Simon Krizan to waive outstanding special assessments on property at 9580 S. Nicholson Road, Tax Key # 909-9999-001

Background:

Mr. Simon Krizan has submitted a request to be placed on the agenda for Dec. 16, 2003, requesting that the Council waive outstanding special assessments on approximately 26 acres of property currently part of a 30.062 acre parcel identified as Tax Key #909-9999-001.     A copy of his written request is attached to this report.

Although staff has had limited time to review Mr. Krizan’s statements, the recommendation is to deny the request.  Staff’s position, barring any further research, is that the assessments as originally levied benefited the property, they were not challenged by the property owner, they were validly levied, and they should remain due and payable.

Fiscal Impact: 

There are currently outstanding assessments for Tax Key #909-9999-001, not including installment payments that will appear on the 2003 tax bill:

Sewer: $3,935.90  This assessment had been deferred, but was made active under the discount incentive program.

Water: $40,206.30  This assessment is active.
