Recommendation:  That the Council adopt Ordinance No. 2287, which would amend the conditions and restrictions for the M-1, PUD at 9803-9835 S. 13th Street to allow dog obedience training facilities, when conducted entirely within an enclosed structure, as a permitted use..

Background:  MIE Properties, Inc. on behalf of Paws-itivly Behaved K-9’s, LLC is requesting that the planned unit development agreement for the Creekside Corporate Park be amended to permit dog obedience training facilities as part of the planned unit development for the Creekside Corporate Park.  More information on the proposal is contained in the attached letter.

Dog obedience training facilities, when conducted entirely within an enclosed structure, are a permitted use in the B-2, Community Business and B-4, Highway Business zoning districts.  Animal hospitals and boarding kennels require a conditional use permit in the M-1, Manufacturing zoning district, the underlying zoning district for this development.

It would seem that if dog obedience training facilities are appropriate as permitted uses in community business districts they would be an appropriate tenant for a business park provided that appropriate measures are taken to insure that the premises are maintained in a clean and sanitary manner.

The Plan Commission has reviewed this request and has recommended that the official map be amended as requested.

Fiscal Impact:  The proposed text amendment does not have any direct fiscal impact on the City, but would allow for the leasing of space within this corporate center to businesses that provide this service.
