Recommendation:  That the Council adopt Resolution No. 10311-111803, approving a certified survey map for the properties at 1421 and 1429 W. Mario Lane.

 

Background:  Picture Perfect Homes is requesting approval of a certified survey map that would redivide the properties at 1421 and 1439 W. Mario Lane.  These two properties, within the Armann Heights subdivision both have homes either completed or under construction.  The home at 1439 W. Mario Lane was developed with a side entry garage, even though the plat of survey for the lot indicated a front load garage.  This is significant since the code requires a side entry garage to be set back a minimum of 27 feet from the side property line.  The existing garage was constructed with less than the minimum setback.  It also appears that a portion of the driveway itself was constructed on the neighboring property.

 

The owners of the lot unsuccessfully applied to the Board of Appeals for relief from the setback provision. 

 

Having been unsuccessful at the Board of Appeals, the applicants are now proposing to purchase 3.5 feet from the neighboring property to achieve the proper setback.  While this creates an unusual shaped lot with an offset side property line, it does preserve the ability of the property owner to keep the side entry garage, something that is preferable from the City’s perspective.  All parties should keep in mind that driveways on both properties must be a minimum of 5 feet from the side property line.

 

The Plan Commission has reviewed this request and has recommended its approval.

 

Fiscal Impact:  This is a redivision of existing, developed properties.  There is no fiscal impact.
