Recommendation: That the Common Council adopt Resolution No. 10293-102103, a resolution approving a sanitary sewer and water lateral connection agreement between Catherine A. Schuerman, 9025 S. Nicholson Road, Oak Creek, WI 53154, and the City of Oak Creek for the property at 9025 S. Nicholson Road, Oak Creek, WI 53154, Tax Key Nos. 861-9987 and 873-9999 (3rd Aldermanic District).
This item was held at the last Common Council meeting. A citizen questioned the ending location of the existing sewer. The attached map shows the sewer location and the terminus.
Background: Catherine A. Schuerman wishes to connect an existing single family home at 9025 S. Nicholson Road to existing public sanitary sewer and water main to provide public sanitary sewer and water service to the property. The Oak Creek Water and Sewer Utility has approved sanitary sewer and water main service laterals to connect to existing public sanitary sewer and water main S. Nicholson Road. This agreement would allow Catherine A. Schuerman’s existing home to connect to public sewer and water mains.
The connection agreement contains provisions for payment of a $1,925.00 connection fee. This fee would be applied to any future public sanitary sewer and/or public water main assessment fee. If the current connection fee is less than the future assessment, Catherine A. Schuerman is obligated to make up the difference. If the current connection fee is more than the future assessment fee, there is no refund forthcoming.
Further agreement provisions that Catherine A. Schuerman has agreed to are: 1) to disconnect the sanitary sewer and/or water main service lateral being installed under this agreement and reconnect to any future public sanitary sewer and/or public water main installed along the street frontage of 9025 S. Nicholson Road, 2) no objection to any future assessments for public sanitary sewer and/or public water main along the street frontage of 9025 S. Nicholson Road.

BE IT RESOLVED that the sanitary sewer and water service lateral connection agreement attached hereto and incorporated herein by reference by and between Catherine A. Schuerman and the City of Oak Creek, providing for a sanitary sewer and water service lateral connection, be and the same is hereby approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk be and are hereby authorized and directed to execute said agreement for and on behalf of the City.
