Recommendation:

That the Common Council adopt Resolution No. 10304-110403, Resolution Requesting that Certain Lands as Located within the City of Oak Creek be Incorporated within the Boundaries of the Milwaukee Metropolitan Sewerage District (MMSD).  (Crayfish Creek Watershed) (4th, 5th and 6th Aldermanic Districts)

 

Background:

Oak Creek currently shows a number of parcels, primarily in the far southeast and far southwest sections of the city, to be outside the boundaries of the service area of the Milwaukee Metropolitan Sewerage District (MMSD).  A complete list of those parcels and a map showing their locations is attached to this report.  Because the MMSD service area now includes all of the land in the city, those parcels should no longer be considered outside the boundaries and should be subject to the MMSD tax levy. 

The City last considered action to modify the boundaries in 1994, but since sewer service was neither available nor planned, the Council at that time felt it was not appropriate to change.  In November, 2000, the Oak Creek Board of Waterworks & Sewer Commissioners requested that the boundaries be modified because MMSD had installed the 27th Street interceptor sewer and designed the 13th Street interceptor sewer, so sanitary service by MMSD was available to the entire city.  Modification of boundaries was not pursued by the City at that time, but is being presented now because of the development and potential development of the City in both the southeast and southwest sections.  While not all individual properties are currently served by sewer, they are all located within the area of service. 

Upon the Council’s approval of this resolution, a certified copy would be sent to MMSD, which would trigger a process by that entity that includes a public hearing so affected property owners would have an opportunity to become informed and offer their comments.  The change would not affect the December 2003 tax bills, but could be in place for 2004, depending on statutory requirements and deadlines determined by MMSD.

 

 

Fiscal Impact:

There is no fiscal impact to the City. The property tax calculations would no longer have to be made separately for MMSD and non-MMSD properties.
