Recommendation:  That the Common Council approve Resolution No. 10284-100703, a resolution approving the vacation of three existing public utility easements, as shown on CSM 6838, across Parcel 2 of the Oak Creek Commerce and Industrial Park (Tax Key No. 766-9020) (1^st Aldermanic District).

Background:  The public utility easements were granted to the City of Oak Creek for Project No. 89009, by

• Resolution No. 7770-060689 and 7805-080189, recorded with the Milwaukee County Register of Deeds on September 19, 1989, as Document No. 6312572, on Reel 2370 as Images 94 to 97, inclusive.
• Resolution No. 7805-080189, recorded with the Milwaukee County Register of Deeds on August 21, 1989, as Document No. 6304135, on Reel 2361 as Images 15 to 16, inclusive.
• Resolution No. 7805-080189, recorded with the Milwaukee County Register of Deeds on August 7, 1989, as Document No. 6300363, on Reel 2356 as Images 1032 to 1034, inclusive.

The current owner, Oak Creek Commerce Development, has requested that the utility easements be vacated.  The easement is not required since the water main has been abandoned.

Fiscal Impact:  None.

RESOLUTION TO VACATE EXISTING UTILITY EASEMENTS ON

CERTIFIED SURVEY MAP NO. 6838, BEING A PART OF THE NW ¼ OF

OF SECTION 9, T 5 N, R 22 E, IN THE CITY OF OAK CREEK

 (TAX KEY NO. 766-9020)

(1^ST ALDERMANIC DISTRICT)

WHEREAS, the public utility easement was granted to the City of Oak Creek for Project No. 89009 by,

• Resolution No. 7770-060689 and 7805-080189, recorded with the Milwaukee County Register of Deeds on September 19, 1989, as Document No. 6312572, on Reel 2370 as Images 94 to 97, inclusive
• Resolution No. 7805-080189, recorded with the Milwaukee County Register of Deeds on August 21, 1989, as Document No. 6304135, on Reel 2361 as Images 15 to 16, inclusive.
• Resolution No. 7805-080189, recorded with the Milwaukee County Register of Deeds on August 7, 1989, as Document No. 6300363, on Reel 2356 as Images 1032 to 1034, inclusive.

WHEREAS, the existing utility easements shown on CSM No. 6838, are not required since the water main has been abandoned.

NOW, THEREFORE BE IT RESOLVED by the Mayor and the Common Council of the City of Oak Creek that the public utility easement as granted to the City of Oak Creek, under Resolution 7805-080189 shall be vacated, and

BE IT FURTHER RESOLVED, that the City Clerk is hereby authorized and directed to cause a certified copy of the resolution to be recorded in the office of the Register of Deeds in and for Milwaukee County, Wisconsin.
