Recommendation:  That the Common Council adopt Resolution No. 10286-100703, a resolution approving a sanitary sewer and water lateral connection agreement between Michael G. and Susan G. Wenzen and the City of Oak Creek for 8770 S. Fieldpointe Drive, Tax Key No. 865-9995 (4th Aldermanic District).

 

Background:  Michael G. and Susan S. Wenzen wish to connect a proposed single family home at 8770 S. Fieldpointe Drive to existing public sanitary sewer and water main to provide public sanitary sewer and water service to the property.  The Oak Creek Water and Sewer Utility has approved sanitary sewer and water main service laterals to connect to existing public sanitary sewer and water main at the southerly terminus of S. Fieldpointe Drive.  This agreement would allow the Wenzen’s proposed new home to connect to public sewer and water.

 

The connection agreement contains provisions for payment of a $5,775.00 connection fee.  This fee would be applied to any future public sanitary sewer and/or public water main assessment fee.  If the current connection fee is less than the future assessment, the Wenzens are obligated to make up the difference.  If the current connection fee is more than the future assessment fee, there is no refund forthcoming.

 

Further agreement provisions that the Wenzens have agreed to are:  1) to disconnect the sanitary sewer and/or water main service lateral being installed under this agreement and reconnect to any future public sanitary sewer and/or public water main installed along the street frontage of 8770 S. Fieldpointe Drive, 2) no objection to any future assessments for public sanitary sewer and/or public water main along the street frontage of 8770 S. Fieldpointe Drive.

            BE IT RESOLVED that the sanitary sewer and water service lateral connection agreement attached hereto and incorporated herein by reference by and between Michael G. and Susan S. Wenzen and the City of Oak Creek, providing for a sanitary sewer and water service lateral connection, be and the same is hereby approved.

 

            BE IT FURTHER RESOLVED that the Mayor and City Clerk be and are hereby authorized and directed to execute said agreement for and on behalf of the City.
