Recommendation: That the Council approve Resolution No. 10289-100703 approving Agreements with the Union Grove Fairgrounds and the Town of Raymond Transferring Ownership of Bleachers.
Background: Earlier this year the Parks, Recreation & Forestry Department purchased five new aluminum bleachers that meet the new International Building Code for bleacher design and construction. The intent was to eliminate several 25 year old wooden plank bleachers needing frame painting, wood seat/foot plank and hardware replacement.
The Oak Creek/Franklin School District and Oelschlaeger-Dallmann American Legion Post 434 expressed an interest in acquiring several of the old wooden bleachers until an environmental consulting firm checked the bleachers for lead and found the paint on the metal frames exceed the State limit for lead in paint.
The Parks, Recreation & Forestry Department currently own 13 of these wooden plank bleachers. The Union Grove Fairgrounds and the Town of Raymond are aware of the condition of the bleachers and the lead content in the paint and want to take ownership. Both agencies have received copies of the bleacher inspection report summary and the lead paint sampling report. The Union Grove Fairgrounds and the Town of Raymond have signed their agreements, which holds the City harmless and indemnifies the City from any liability.
The intent of the City is to transfer ownership of nine bleachers to the Union Grove Fairgrounds and four bleachers to the Town of Raymond upon approval of the agreements by bill of sale in “as is” condition at no cost. Each agency will be responsible for transporting the bleachers to that agencies location.
Fiscal Impact: The transfer of ownership of the bleachers eliminates the need for costly paint removal and repairs. New aluminum bleacher replacements are not being requested at this time.
