Common Council Report

Meeting Date: March 4, 2003

Recommendation: That the Common Council authorize the City Clerk to issue a Notice of Disallowance on the claim of Taip Lumani.

Background: A claim was filed in the amount of $1,500.00 by Attorney Donald Conner II on behalf of his client, Taip Lumani, for an incident which occurred on 8/9/02. Mr. Lumani reported that while a Parks, Recreation and Forestry employee was cutting the grass, the mower kicked up a stone which flew through the open window of the vehicle he was driving, and hit him in the face. This matter was reviewed by the City Attorney and the City’s insurance carrier, Cities and Villages Mutual (CVMIC), who both recommended that a Notice of Disallowance be issued. The Small Claims Committee has concurred with this recommendation.

Fiscal Impact: None at this time.
