Recommendation:  That the Common Council adopt Resolution No. 10527-070505, a resolution accepting a quit claim deed for acquisition of public right-of-way across 8921 S. 5th Avenue (Tax Key No. 865-9973) (4th Aldermanic District).

 

Background:  David and Doreen Schmidt are the property owners and have prepared a quit claim deed and legal description for the land being deeded to the City as public right-of-way.  The right-of-way being acquired contains an asphalt-paved alley that the City plows and maintains.  The alley is scheduled to be repaved this year under the 2005 Road Improvements contract that the City has with Payne & Dolan.

 

Many years ago the right-of-ways for the alleys and streets in this neighborhood were deeded to the City.  This year it was discovered that the right-of-way for this alley had not yet been deeded to the City.

RESOLUTION NO. 10527-070505

RESOLUTION ACCEPTING QUIT CLAIM DEED

FOR PUBLIC RIGHT-OF-WAY

AT 8921 S. 5th AVENUE

(4TH ALDERMANIC DISTRICT)

 

            WHEREAS, the City of Oak Creek desires acquisition of public right-of-way across 8921 S. 5th Avenue in order to own and maintain the paved alley.

 

            WHEREAS, the quit claim deed has been prepared affecting the following property owners, to wit:

 

David P. and Doreen J. Schmidt

8921 S. 5th Avenue

Tax Key No. 865-9973

 

and said quit claim deed is attached hereto.

 

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Common Council of the City of Oak Creek that the attached quit claim deed is hereby accepted by the City.

 

BE IT FURTHER RESOLVED that the Mayor and the City Clerk are hereby authorized and directed to execute the attached quit claim deed on behalf of the Common Council of the City of Oak Creek and upon said execution the City Attorney is authorized and directed to record the same in the Office of the Register of Deeds in and for Milwaukee County, Wisconsin.
