Approval of minutes:  5/6/03, 5/19/03, and 5/20/03, as published.

Public Hearings (beginning at 7:00 p.m.) Citizen input, comments and suggestions are requested on the specific item(s) identified below.  Action by the Council may occur at the same meeting if so included in the agenda.

  1. Rezone:  Consider the request of WE Energies to rezone the properties at 4420, 4500, 4650, 4750 and 4800 E. Elm Rd., as well as 4285, 4299, 4431, 4451R, 4503, 4513, 4541 and 4541R E. Oakwood Rd. from A-1 Agricultural, P-1 Park, M-1 Manufacturing and Rs-4 Single Family Residential to M-1 Manufacturing (4th District).
  2. Conditional Use Permit:  Consider the request of WE Energies for a conditional use permit in the M-1 Manufacturing zoning district that would allow for power generation and distribution for the properties identified on the public hearing notice (4th District).

  4. Ordinance:  Consider ordinance No. 2250, rezoning the properties at 4420, 4500, 4650, 4750 and 4800 E. Elm Rd., 4285, 4299, 4431, 4451R, 4503, 4513, 4541 and 4541R E. Oakwood Rd. from A-1 Agricultural, P-1 Park, M-1 Manufacturing and Rs-4 Single Family Residential, to M-1 Manufacturing (WE Energies) (4th District).
  5. Ordinance:  Consider ordinance No. Ordinance No. 2251, authorizing the issuance of a conditional use permit to the Wisconsin Energy Corporation for power generation, transmission and distribution for the properties in the M-1 Manufacturing zoning district at 4401, 4415, 4420, 4500, 4501, 4650, 4750, 4800 and 4801 E. Elm Road; 4285, 4299, 4431, 4451, 4503, 4513, 4541 and 4541R E. Oakwood Road; 10700, 10760, 10920, 11002, 11050 and 11050R S. Chicago Rd. (4th District).
  6. Informational:   formation of the ad hoc Veterans’ Memorial Park Committee and the Mayor’s recommendations for committee membership as listed on the attached Council report (by Committee of the Whole).
  7. Final recommendations of the ad hoc Blue Ribbon Volunteer/Paid-On-Call Firefighters Study Committee.

  9. Council Proclamation:  Consider council proclamation 03-7, congratulations to Nicole Ayala for receiving the Girl Scout Gold Award (by Committee of the Whole).
  10. Motion:  Consider a motion to concur with the following Mayoral reappointments and new appointments (* denotes a new appointment):
    1. Finance Committee
      *Patrick Shanahan, 8100 S. Woodridge Dr., to complete a term expiring 9/04
    2. Board of Review, Alternate No. 2
      *Dennis McNulty, 7544 S. Lynhaven Dr. (with Bradley Evans moving up to a regular member and Thomas V. S. Lewison moving up to Alternate No. 1)
    3. Board of Zoning/Housing Appeals, Alternate No. 1
      *Robert Bosetti, 320 E. Kendale Dr., for a three-year term to expire 4/06 (and Randy Gregorek moving up to a regular member).
  11. Motion: Consider a motion to approve the Vendor Summary Report in the amount of $685,084.16 (by Committee of the Whole).
  12. Ordinance:  Consider ordinance No. 2252, amending Section 5 of Ordinance No. 2192, to add the position of part-time Emergency Services Dispatcher, with a salary range of $14.364-$17.269 per hour (by Committee of the Whole).
  13. License Committee

  14. Motion: Consider a motion to take action on the various license requests as listed on the attached report (by Committee of the Whole).

  16. Motion:  Consider a motion to authorize payment of the contract progress payments for Project Nos. 00045, 02014 and 02027, as listed on the attached summary report (2nd, 3rd and 6th Districts).
  17. Motion:  Consider a motion to authorize a payment of $3,497.12 to Land Acquisitions, Inc., for their work on the real estate acquisitions for the Pennsylvania Ave. reconstruction project (Project No. 99022) (3rd District).
  18. Resolution:  Consider resolution No. 10244-060303, approving a development agreement for sanitary sewer and a water lateral connection agreement with Cummins NPower at 840 W. Ryan Rd. (6th District).
  19. Resolution:  Consider resolution No. 10250-060303, acquiring fee property, permanent easement, and temporary easement for the S. Pennsylvania Ave. reconstruction project, and to send a check in the amount of the Award of Damages to the property owner (Project No. 99022) (3rd District).

  21. Motion:  Consider a motion to not adopt Resolution No. 10245-060303, approving a certified survey map for the properties at 3240 E. Woodview Ave. and 9330 S. 15th Ave. (Emil and Sandra Kling) (4th District).
  22. Resolution:  Consider resolution No. 10246-060303, accepting the offer of dedication of street right-of-way located adjacent to lands at 9170 S. Shepard Ave. (Judith Finke, Jacqueline Kopplin and Thomas Schmidt) (3rd District).
  23. Resolution:  Consider resolution No. 10247-060303, accepting the offer of dedication of street right-of-way located adjacent to lands at 511 and 517 W. Oakwood Rd. (Marion and Grace Klamik) (5th District).
  24. Resolution:  Consider resolution No. 10248-060303, approving the development agreement for the subdivision known as Riverview Estates Addition No. 2, 860 W. Riverside Dr. (6th District).

    Miscellaneous

  25. Motion:  Consider a motion to convene into Executive Session immediately following the conclusion of the Common Council meeting, pursuant to Wisconsin State Statutes, Section 19.85(1)(e) to discuss consideration of a contract amendment with RMT Technologies and continuing negotiations with WE Energies relating to the power plant expansion.
  26. Motion:  Consider a motion to reconvene into Open Session.
  27. Motion:  Consider a motion to take action, if required.
