2. Ordinance: Consider ordinance No. 2232, approving a rezoning of the properties at 8781 and 8931 S. 5th Ave. from Rs-3 and Rs-4 Single Family Residential and Rd-1 Two-Family Residential to Rs-3 Single Family Residential Rm-1 Multifamily Residential, B-1 Local Business and P-1 Park (David and Doreen Schmidt) (4th District).
3. Presentation: Presentation by the City Administrator on the proposed power plant expansion (held 1/21/03).
4. Motion: Consider a motion to concur with the recommendation of the Director of Parks, Recreation and Forestry and approve the purchase of two GMC trucks from Bob Fish Buick/Pontiac/GMC in the amount of $34,625.00 (held 1/21/03) (by Committee of the Whole).

11. Proclamation: Consider Council Proclamation No. 03-3, congratulations to Mike Robe and Bryan Jahns for winning the Top Ops Competition (by Committee of the Whole).
12. Motion: Consider a motion to approve a revised distribution of the City’s 2003 Community Development Block Grant (CDBG) funding (by Committee of the Whole).
13. Motion: Consider a motion to accept the recommendation of the Finance Committee and direct that an ordinance be prepared increasing residential green space and house values (by Committee of the Whole).
14. Motion: Consider a motion to approve the Vendor Summary Report in the amount of $470,458.78 (by Committee of the Whole).

15. Motion: Consider a motion to take action on the various license requests as listed on the attached report (by Committee of the Whole).

16. Ordinance: Consider ordinance No. 2231, amending Section 11.01 of the Oak Creek Municipal Code to include, by reference, Wisconsin State Statute 948.45(1) relating to contributing to the truancy of a child (by Committee of the Whole).
17. Motion: Consider a motion to approve the proposed Agreement for Cellular Communications Tower Use between the City of Oak Creek and Enforcer Group, Inc. (by Committee of the Whole).
Engineering
18. Motion: Consider a motion to authorize payment of the contract progress payments for Project Nos. 97037 and 02002, as listed on the attached summary report.
19. Resolution: Consider resolution No. 10210-020403, accepting the workmanship and authorizing final payment to Roberts Roofing & Siding, Inc., for Project No. 02031 (installation of roofing improvements at the Street Dept. salt shed) (2nd District).
20. Resolution: Consider resolution No. 10209-020403, acquiring fee property and permanent easement for the Pennsylvania Ave. reconstruction project from Puetz Rd. to Ryan Rd., and send a check in the amount of the Award of Damages to the property owner (Project No. 99022) (3rd District).
21. Motion: Consider a motion to amend the contract with Land Acquisitions, Inc., in the amount of $2,996.25, to renegotiate with and secure the nominal appraisal for the former Cannon Group site, and to cover the cost of recording fees for the Pennsylvania Ave. reconstruction project from Puetz Rd. to Ryan Rd. (Project No. 99022) (3rd District).
Community Development
22. Resolution: Consider resolution No. 10212-020403, approving the certified survey map for the property at 1120 E. Ryan Rd. (Terence Richter) (3rd District).
Miscellaneous
23. Motion: Consider a motion to convene into Executive Session immediately following the conclusion of the Common Council meeting, pursuant to Wisconsin State Statutes as follows:
a. Section 19.85(1)(e)(g) to discuss potential litigation and negotiations with WE Energies relating to the proposed power plant expansion;
b. Section 19.85(1)(e) to discuss negotiating a change in the consulting contract with RMT Technologies, Inc., as it relates to the proposed power plant expansion; and
c. Section 19.85(1)(e) to discuss filling the position of Building Commissioner.
24. Motion: Consider a motion to reconvene into Open Session.
25. Motion: Consider a motion to take action, if required.
26. Ordinance: Consider ordinance No. 2236, establishing a salary for Building Commissioner.
