Animal Regulations

The following is a brief summary of the various Municipal Ordinances regulating pets in the City of Oak Creek.

Licensing. In accordance with Section 7.40 and Section 7.49 of the City of Oak Creek Municipal Code, every person residing in the City who owns a dog or cat which is more than five (5) months of age on January 1st of any year shall annually obtain a dog/cat license.

In addition, no owner, person or family residing within the City of Oak Creek shall keep more than two (2) dogs, with the exception of a litter of pups which may be kept for not more than five (5) months from birth.

Running At Large. It is unlawful for the owner or keeper of a dog to permit the dog to run at large in the City of Oak Creek. A dog will not be deemed “at large” if it is kept on the premises of its owner/keeper or if it is held on a leash not longer than ten (10) feet. With the exception of the Milwaukee Runway Dog Exercise Park located at 1214 E. Rawson Avenue, it is prohibited to allow dogs to run loose in any city or county park in the City of Oak Creek. Many parks prohibit dogs entirely. Details on specific dog restrictions for a particular park can be obtained by contacting the Oak Creek Parks Department at (414) 768-6515 or the Milwaukee County Parks Department at (414) 257-PARK.

If a dog is found and turned over to the Police Department and the owner cannot be located, the dog is turned over to the Milwaukee Area Domestic Animal Control Commission (MADACC). Their facility is located at 3839 W. Burnham Ave., in West Milwaukee (649-8640).

Barking Dogs / Crying Cats. Dogs that habitually bark/howl/yelp or cats that habitually cry/howl to the great discomfort of the peace and quiet of the neighborhood are prohibited. Such dogs and cats are considered a public nuisance. When two (2) formal complaints are filed with the Police Department within a four (4) week period, the owner can be issued a Municipal Citation.

Dog Litter. All dog owners shall be responsible for cleaning up their pet’s fecal matter which has been deposited while off its own premises, on any street, alley, sidewalk, lawn, field or property.

Damage to Property by Animals. It is unlawful for any person owning an animal to allow such animal to go upon any parkway or private lands or premises without the permission of the owner and break, bruise, tear up, crush, or injure any lawn, flower bed, plant, shrub, tree, or garden in any manner whatsoever, or to defecate or urinate thereon.

Vicious Dogs. It is unlawful for any person to harbor or keep a vicious dog within the City of Oak Creek. A dog is declared to be vicious when it has bitten any person, or when a propensity to attach or bite human beings or other animals exists and is known to the owner or any member of the owner’s immediate family. Any person who owns or harbors a vicious dog that has been the basis of two (2) or more previous violations shall be required to have such dog destroyed. Note: The previous violations don’t need to have occurred within the City of Oak Creek.

Any animal known to have bitten any person is subject to a minimum ten (10) day quarantine period

Wild Animals. The City prohibits anyone from keeping, harboring or owning any wild or exotic animals including, but not limited to, raccoons, skunks, foxes, poisonous animals and reptiles (including rear-fang snakes), constrictor snakes (six [6] feet in length or more), crocodilians (thirty [30] inches in length or more), coyotes, game cocks and other fighting birds, wolves (or wolf hybrids or any animal resulting from the breeding of a wolf with a domestic dog), apes, baboons, bears, bison, cheetahs, hyenas, jaguars, leopards, lions, lynxes, ostriches, pumas, sharks, tigers, and, except in properly zoned districts, horses, mules, ponies, donkeys, cows, pigs, goats, sheep, chickens, poultry or any animal raised for fur-bearing purposes.
